VERY SAD UPDATE – READ ME!

On April 23, 2011, Mystical Moon submitted its notification (via fax and email) to exercise its rights as defined in Section 9 (DISPUTE RESOLUTION) of Exhibit A of the executed Version 3.0 Master Team Agreement (MTA). In that notification Mystical Moon requested that the X PRIZE Foundation (XPF) confirm receipt of the correspondences and requested that XPF contact Mystical Moon. On April 25, 2011, Mystical Moon tried several times to call XPF during the morning business hours (Pacific Time) with no success. Finally, that afternoon, a temporary receptionist answered the phone and requested that we re-send the facsimile. Mystical Moon again requested confirmation of the receipt of the notification and invited XPF to please contact us. We hoped that XPF would want to open a dialogue to discuss the matter promptly but are sadly mistaken. Unfortunately, that evening, we received an email from Mr. Donell stating “I have received your correspondence and will respond accordingly by Friday, April 29, 2011.”

Instead of quickly initiating the actions to “getting this problem fixed”
(as Phil suggests here http://www.googlelunarxprize.org/lunar/teams/selene/blog/short-open-lett... ), XPF (and Google) decide to launch a “Public Relations (PR) Campaign” by quickly posting a video (within hours) about STEM education on the GLXP web site: http://www.googlelunarxprize.org/

The presence of Larry Page and Sergey Brin in the video can only be interpreted as confirmation that Google is intimately involved in all of these actions. The fact that XPF and Google choose to conduct a media campaign to try to cover up these actions rather than address the matter properly speaks volumes to their true motivation. Their words do not justify their continued “bully" tactics and threats to “disqualify” the only GLXP team composed of K-12 grade students whose PRIME objective is STEM education. Mystical Moon finds these actions very insincere and disingenuous. How can Google justify their actions to deny children from around the world the opportunity to participate in the Google Lunar X PRIZE competition especially if they have already acknowledged that it is merely an “advertising gimmick”? Moreover, these actions lend significant credence to the content of stockpotato’s comment

Lastly and very sadly, Mystical Moon has not received the “accordingly” response from XPF and/or Google at the time of this posting.
